Clinton man arrested for possessing, producing & distributing child porn

CLINTON (KATV) – Nicholas Derose, 42, remains behind bars Thursday night charged with 41 counts of possessing child pornography.  But Derose isn't just charged with possessing child porn – he's also charged with producing and distributing it.

Deputy Chief Prosecutor for the 20th Circuit, Troy Braswell said those 41 counts of possession indicate 41 different images and videos Derose had in his custody.  The prosecuting affidavit states even though they've found just 41 media items – the investigation into Derose isn't over and they expect to uncover more.

Derose was arrested on Monday at his home at 410 Glacier Drive in Clinton.  Agents with the Department of Homeland Security, United States Secret Service, Arkansas State Police and the Van Buren County Sheriff's department conducted a search warrant of his home and discovered a computer in his bedroom with pornographic images of child on it. 

Neighbors across the street from Derose, Ruth and John Crabtree, say they've known Derose for years.  They're still trying to digest the news.

"That's the most disturbing part," said John Crabtree, when discussing the fact Derose actually produced the pornography himself.

Crabtree said he cut off ties with Derose nearly five years ago, citing something was off about him, but Crabtree never expected something like this.

"There was no outward sign that I could see," said Crabtree.  "That's where the shock comes in."

When Derose was taken into custody, according to the affidavit, he admitted to possessing the pornography in addition to the production and distribution of the media.  His admission of guilt was given even after being read his Miranda Rights.  Braswell believes he will eventually plead "not guilty" at his arraignment on February 10, but couldn't comment on his admission of guilt upon arrest.

Braswell said this case is one he takes seriously and very personally with two children of his own.

"We have to view evidence, we have to understand the type of case that we have," said Braswell.  "Those images stick with you – they burn in your mind."

The investigation so far has only produced one victim the prosecutor's office is aware of, but they said they aren't ruling out the possibility of other victims.

Each count of possession of child pornography carries a sentence of between 3-10 years in the Arkansas Department of Corrections.  Braswell says Derose could face up to 410 years in prison, but the way Arkansas law works he could be eligible for parole in one-sixth of the time – regardless of the actual sentence.

Derose is currently being held in the Van Buren County Jail on a $250,000 bond.
