Judge recuses in Arkansas abortion-ban lawsuit

Posted: Updated:

LITTLE ROCK (AP) - A lawsuit challenging Arkansas' new law banning most abortions after 12 weeks of pregnancy has been assigned to a new federal judge.

U.S. District Judge Billy Roy Wilson issued an order this week recusing from the lawsuit filed by the American Civil Liberties Union of Arkansas and the Reproductive Rights Center on behalf of two Arkansas doctors who perform abortions.

In his order, Wilson says although the case has "the earmarkings of a lively, interesting lawsuit," he must recuse because of his connections with attorneys and parties involved in the lawsuit.

The lawsuit is now assigned to U.S. District Judge Susan Webber Wright.

The lawsuit claims that the new law denies patients their constitutional right to end a pregnancy before the point of viability.
