UPDATE: Judge rules Ark. lethal injection records FOI exempt

LITTLE ROCK (AP) - A Pulaski County judge has ruled that documents relating to lethal injection drugs the Arkansas Department of Correction will obtain are exempt from the state's Freedom of Information Act.

Judge Collins Kilgore's two sentence ruling Monday says the information sought by six death row inmates is exempt from the FOIA and denied their request that he order the records be released.

Kilgore heard arguments earlier Monday from attorney Jeff Rosenzweig for the inmates who argued for release of the information. Assistant Attorney General David Curran argued that the records are exempt.

The state Legislature last month enacted a new lethal injection law that requires use of a lethal dose of a barbiturate, but leaves it up to the Department of Correction to determine which drug.
