(KATV) A prosecutor in Ohio says we've been misled about an early spring. So he wants a head to roll, a little furry head.

Even though the calendar says it's spring, you wouldn't know it by the weather. Because of that, Butler County Prosecutor Michael Gmoser says Punxsutawney Phil should be indicted.  He says, "The response has been very positives here in Butler Country. I mean most people around here want a piece of Phil. I'm getting recipes, I mean people are firing up their grills and they want to take it out on Punxsutawney Phil."

The Groundhog is charged with an unclassified felony for saying we'd have an early spring. However one of Phil's handlers is coming to his defense. He says temperatures reached 60 or 65 degrees more than two weeks ago, so that essentially counts as an early spring.
