Eyewitness statement resulted in wrong arrest

(KATV) On January 6th at about 1 in the afternoon, Little Rock police responded to a hit and run at Kavanaugh and Beechwood.

Witnesses described the vehicle as a white truck with a military tag of AAEF. Investigators were able to locate 26 military tags through the ACIC database. A few days later they arrested Steven Kissinger.

Police say a witness was able to identify Kissinger as the driver. Kissinger was arrested and charged with careless and prohibited driving and leaving the scene of an accident. 

However, upon further investigation it was determined that Kissinger's truck was similar in color and style to the suspect vehicle, but it was not involved in the hit and run. Investigators also determined that Kissinger resembled the suspect but he was not the driver. The case against Steven Kissinger has been Nolle Prosequi, that means he will not be prosecuted.

On Monday, March 18, Claude Smith, 42, turned himself in and was charged with felony hit-and-run, careless and prohibited driving, failure to yield in a pedestrian crosswalk, driving on a suspended driver's license, having expired vehicle registration, and having no insurance.
