POTEAU, Okla. (AP) - Prosecutors are seeking the death penalty for 1 of 2 men charged in the east Oklahoma slaying of a Fort Smith, Ark., woman.
Prosecutors announced Wednesday that they'd pursue execution for 24-year-old Johnathen Thacker.
Thacker and his brother, Elvis Thacker, are each charged with first-degree murder for the 2010 slaying of 22-year-old Briana Jane Ault of Fort Smith.
The Southwest Times Record reports no decision has been made yet on whether to seek execution for Elvis Thacker, who was ordered to undergo a mental evaluation.
The brothers are already serving time for convictions in Arkansas, including the stabbing of Fort Smith officer.
Ault's body was discovered in a pond in Pocola. A police report said her throat was slashed.
Thacker pleaded not guilty. Trial is set for Jan. 13.
