Judge to hear from lawyers in WM3 evidence case

MARION, Ark. (AP) - A judge is expected to hear from attorneys in a lawsuit filed by the mother of 1 of 3 Cub Scouts killed in northeast Arkansas in 1993.

The hearing is to get under way Wednesday in Marion after Pam Hicks filed a civil lawsuit in hopes of viewing evidence in the slaying of her son, 8-year-old Stevie Branch, and his friends, Michael Moore and Christopher Byers.

Hicks argues that police and prosecutors are violating Arkansas' Freedom of Information Act by not allowing her to examine items from the case that include her son's bicycle and clothes.

Prosecutor Scott Ellington has said he's willing to let Hicks view the bicycle and clothing but that he won't release all investigative materials.
