Gary Dunn Released Not to be Retried

The man charged in the death of Arkansas Tech student Nona Dirksmeyer will be a free man today.

Garry Dunn was scheduled for a pre-trial hearing in the death of the beauty queen, with the murder trial set for August.

Dunn has already been tried in the case twice, with both proceedings ending in a mistrial.

Channel 7 News has a crew in Russellville, and will have details on Midday and Live at Five.

Meanwhile, Kevin Jones, Dirksmeyer's former boyfriend who was acquitted of her murder, has filed a civil lawsuit against the man who prosecuted him in 2007.  Jones is seeking documents from prosecutor Jack McQuary in the current case against Dunn.

McQuary has said he will not release the documents because the case is ongoing.
