Little Rock - A Pulaski County judge has ruled he doesn't have the authority to force Governor Mike Beebe to certify an Altus man as mayor of the northwest Arkansas town.

Judge Chris Piazza on Tuesday dismissed the lawsuit filed against Beebe by 61-year-old Gary Zolliecoffer. Zolliecoffer was disqualified after winning the November 2006 election for the Franklin County town after authorities found out that he has two 45-year-old felony convictions.

The judge said it would violate the Arkansas Constitution's separation of powers if he were to force the governor to certify Zolliecoffer as the winner.

Zolliecoffer's attorney indicated he would appeal Piazza's Tuesday decision, even though the term Zolliecoffer won expires in about 16 months.
