A federal appeals court says the head of Arkansas' state prison system and a guard did not violate a pregnant inmate's constitutional rights by shackling her during childbirth.
The 8th U.S. Circuit Court of Appeals at St. Louis ruled Friday that Arkansas Department of Correction Director Larry Norris and guard Patricia Turnesky should be immune from the lawsuit by Shawanna Nelson. The appeals court found that shackling Nelson did not violate her Eighth Amendment rights, nor that anyone "deliberately disregarded Nelson's medical needs" during the 2003 birth.
In 2004, the state prison system banned shackling pregnant women as a compromise with state legislators and a nonprofit group opposed to the practice.
