Little Rock - The Arkansas Court of Appeals is upholding a state panel's decision to revoke the law enforcement certification of a former state trooper who resigned during an investigation into his suspected drug use.
The court on Wednesday reversed a Jefferson County Circuit Court's decision to overturn the order by the Arkansas Commission on Law Enforcement Standards. The commission in 2006 revoked the certification of Arlanders Davis, who had worked for Arkansas State Police since 1977.
According to the ruling, Davis tested positive for cocaine at a level five times the federal cut-off limit for exposure by passive inhalation. Davis said he had never used cocaine, but said he had been riding in a car with a friend who had been smoking homemade cigarettes containing crack cocaine.
Davis had argued that he didn't resign during the internal investigation, but had retired. The appeals court sided with the commission that the trooper had resigned while an internal investigation was pending.
