The state Supreme Court says that a 1963 law that gives most of the road funds in Benton County to Bentonville, Rogers and Siloam Springs is constitutional.
The high court upheld a lower court's ruling today. Benton County had appealed that decision, saying that the legislation violates the state constitution's ban on funding strictly local projects.
The law says that 90% of road funds collected within Bentonville, Rogers and Siloam Springs should go toward those three cities.
In a 6-1 ruling, the court said that the county failed to show that the law was not related to achieving any legitimate purpose of state government.
